COLUMBUS, Ohio (WKBN) – Ohio state officials and the Ohio Department of Commerce Division of Cannabis Control (DCC) are expressing concerns over the marketing of unregulated cannabis products.
On Thursday, the DCC issued a consumer alert regarding Delta-8 THC cannabis products that feature packaging appealing to children. The Food and Drug Administration and the Federal Trade Commission have already sent cease and desist letters to five companies for using packaging that imitates popular children's food items.
These letters demand that the companies immediately stop marketing these products to children, according to a DCC news release.
The issue with Delta-8 and other hemp products is their lack of regulation and potential for intoxication. The DCC noted that some children have fallen ill, with a few requiring hospitalization.
Current Ohio law does not prohibit the sale of intoxicating hemp products, including to children. Governor Mike DeWine is advocating for the removal of these products from store shelves, and state agencies are urging the General Assembly to pass legislation to regulate their sales and marketing.
“As the division prepares to introduce non-medical cannabis products that have met our highest standards of testing and safety, we must ensure dangerous, unregulated products such as Delta-8 are removed from circulation. The packaging of these products can make them look exactly like candy, and the products themselves lack any testing requirements. Thus, Ohio consumers, especially children, have no way of knowing exactly what they are purchasing, which is extremely dangerous,” stated DCC Superintendent Jim Canepa.
DCC-regulated products sold to adults differ significantly from common retail store hemp products or those containing Delta-8 THC. Adults purchasing a product from a licensed seller in Ohio will see the DCC logo on the package.
